When you use or register with the Site, hereinafter defined, AMS Practice Management LLC and its affiliates and subsidiaries (Collectively, “AMS”, “we”, or “us”) may collect, use, transfer, and/or disclose certain information in connection with helping companies recruit new personnel and to attract talent (“Recruitment Services”).  AMS takes the privacy and security of your information seriously.

Information We Collect

AMS collects information that identifies you as an individual or relates to an identifiable individual (“Personal Information”).  The type of Personal Information we collect about you may include, without limitation, your name, address, telephone number, e-mail address, resume information (e.g. employment history, education, professional credentials, memberships in professional organizations, skills, etc.) citizenship, answers to demographic and other survey or assessment questions, information from former employers and other references, and photos you provide or that you make publically available on the internet (e.g. LinkedIn).  Demographic information will not be collected unless permitted to do so by applicable law (e.g. US equal opportunity monitoring).  In accordance with and where permitted by applicable laws, we may obtain background verification information, and compensation and benefits information.  While using our online systems, we may collect user login credentials such as user names, passwords, and password hints.

 

How We Collect Personal Information

AMS may collect Personal Information about you from third parties, clients to whom we provide services, and from information you provide directly to us.

 

You provide Personal Information directly when you register or use our Site, submit or build a resume, respond to employment opportunities, complete online assessments or surveys, participate in online courseware, or contacting us by e-mail, electronic forms, telephone, or U.S. mail.  By providing Personal Information, you represent and warrant that you have the authority to so provide and permit AMS to use the information in accordance with this Policy.

 

In connection with providing Recruitment Services, we may also obtain Personal Information about you from third parties including without limitation our clients, professional recruiting firms, referrals, networking activities, public databases, joint marketing partners, licensed databases, and social medial platforms.

 

How We Use Personal Information

AMS uses Personal Information to register you with our Site, to provide you with information regarding employment opportunities and career-related information, for record keeping in relation to recruiting and hiring, and to otherwise provide you with information or services related to Recruiting Services.  We may from time to time use your Personal Information to send you automated email messages, text messages (message and data rates may apply), or marketing materials regarding our services, including employment information.  We may also use Personal Information for our business purposes, such as data analysis, audits, and improving our services.  We use Personal Information to render services to you and our clients.  We do this to fulfill our contractual relationships with you and our clients and where we have a legitimate, beneficial interest in using Personal Information to conduct our business.

 

If there is a conflict between the use of Personal Information pursuant to this Policy and the requirements under applicable law, applicable law will prevail. 

 

Consent to Receive Marketing Messages and Calls

By providing your home and/or mobile phone number to AMS, you opt-in and consent to receive phone calls and text messages (standard rates may apply) from us, which includes but is not limited to calls and text messages sent through an automatic telephone dialing system.  Consent to receive marketing phone calls and text messages is not required as a condition of utilizing any services from us.  If you do not wish to receive marketing phone calls and text messages from AMS, do not provide us with your phone number. 

 

Collection and Use of Other Information

“Other Information” consists of any information that does not reveal your specific identity or does not relate to an identifiable individual.  Because Other Information does not reveal your specific identity, we may use it for any purpose.  AMS may collect Other Information in a variety of ways, including without limitation, through your browser or device, using cookies (small text files placed on a visitor’s computer hard drive), using pixel tags and other similar technologies, third party analytics such as Google Analytics, and your IP address (a number automatically assigned to your computer by your Internet Service Provider). 

 

Retention

How long AMS retains your Personal Information varies with the purpose(s) for which it was obtained.  Retention periods are determined based on: (i) the length of our ongoing relationship with you or our client; (ii) beyond the time of the ongoing relationship if we have a legitimate need, such as for analysis, record keeping and data compliance schedules; (iii) the existence of a legal obligation to retain the Personal Information for any period of time; or (iv) whether retention is advisable given legal considerations such as statues of limitations, litigation, or regulatory investigations.  

 

Notwithstanding the forgoing, if you accept an offer of employment by one of our clients, any relevant Personal Information collected during your pre-employment period will become part of your personnel records and will be retained in accordance with applicable local law and our client’s retention policies.

 

Rights

Your provision of Personal Information to AMS is voluntary, although if you do not provide certain Personal Information you may not be able to participate in our Recruiting Services.  You may request access to your Personal Information that we have collected about you for the purpose of reviewing, modifying, or correcting any inaccuracies.  You may request that we cease collecting your Personal Information at any time.  

 

Requests to access, review, or correct Personal Information we collected about you, should be directed to hr@amsmanagements.com.  It is our policy to take reasonable steps to verify your identity prior to granting access to any Personal Information.  Depending on the circumstances and the request, we may not be permitted to provide access to Personal Information; for example, where doing so would reveal the identity of someone else.  We reserve the right to charge a reasonable fee for complying with your request where permitted by applicable law and/or to deny requests where, in AMS’s sole discretion, they may be unreasonable, excessive, or otherwise prohibited by law.

 

If you no longer want to receive marketing-related emails from us on a going-forward basis, you may opt-out by using the mechanism contained in each such email.  Additionally, you may opt-out of receiving marketing phone calls or text messages by sending an email to hr@amsmanagements.com or calling 800-557-6092.

 

Third Party Services

This Policy does not address, and AMS is not responsible for, the privacy, information, or other policies of any third parties, including without limitation and third party operating any site or service to which our Site links. 

 

Security

AMS uses reasonable organizational, technical, and administrative measures designated to protect Personal Information within our organization.  Unfortunately, however, no security system, or system of transmitting information over the internet can be guaranteed to be 100% secure.

 

Use of Site by Minors

 

The Site is not directed to individuals under the age of eighteen (18) and AMS does not knowingly collect Personal Information from individuals under eighteen (18).  We request that these individuals do not provide us with their Personal Information. 

 

Revisions to Policy

 

AMS reserves the right to change this Policy at any time for any reason.  The “Last Updated” line at the top of this page indicates when this Policy was last revised.  Any changes become effective when the revised Policy is posted on the Site.  You accept the revised Policy upon using the Site.
